In the case of prevention of suicide by the police, the public duty to protect human life collides with the constitutional right of self-determination which includes the decision about one’s own death. In accordance with the principle of autonomy, prevention of suicide is legitimate only if the decision to suicide is not expression of free will. With regard to criminal law, the police are likewise obligated to prevent suicide only in the case of an unfree decision to suicide. However, neither are all decisions to suicide based on psychological disorder nor are they unfree, as research shows. The police practice is faced with the challenge to evaluate the psychological condition of the suicidal person situationally. This can succeed with the help of psychiatric or psychological professionals only.
