The Portuguese territory contains an appreciable amount of geological resources, especially minerals, including medicinal mineral waters. The interest in mining and its legal regulation has been present since the foundation of Portugal, at the beginning of the 12th century. The Portuguese territory contains an appreciable amount of geological resources, especially minerals (metal mining), rock minerals (agregates), and medicinal mineral waters. The interest in mining activities and its legal regulation has been present since the foundation of Portugal, at the beginning of the 12th century. The present study describes the ways in which this use of mining resources has been made throughout Portuguese history, especially since the democratization of the Portuguese political regime, in 1974 — in particular the new legal framework approved in 2015 and the subsequent regulation (e.g. ownership, entitled to mining) — and tends to highlight the difficulties experienced by investors in mining activities, in view of the rules of spatial planning and protection of the environment.
